TAP Flight Pass Terms and Conditions

The terms and conditions below ("Terms and Conditions") apply to, Flight Pass, which allows all passengers to buy a package pass for multiple trips on TAP Air Portugal airline for pre-selected destinations.

When you buy a Flight Pass for TAP, you enter into a contract with Optiontown and TAP Air Portugal. The customers that buy a TAP Flight Pass, agree to be bound by these Terms and Conditions. Optiontown and Transportes Aéreos Portugueses, S.A., trading as "TAP Air Portugal" (also and referred to as "TAP" or "TP"), reserves the right to modify or make any changes to these Terms and Conditions, as it deems necessary. The customer should consult the document in force at the time of submitting his/her bid. The English version of the Terms and Conditions shall prevail over the other versions (translations).

TAP Air Portugal General Conditions of Carriage will govern the ticketed booking, all the Fare conditions and our regulations, itinerary and receipt.

The Flight Pass Service is administered by Optiontown Ireland Limited, an Ireland limited liability company ("OT", d/b/a Optiontown) having its registered address at Mespil Business Center, Mespil House, Sussex Road, Dublin 4, Ireland along with Optiontown, Inc., a Massachusetts Corporation, having its mailing address at PO BOX 42 Walpole, MA 02032, USA (both jointly referred to as "OT") on behalf of TAP Air Portugal, Transportes Aéreos Portugueses, S.A.

Please note that these TAP Flight Pass Terms, together with the Optiontown Terms of Service constitute the entire agreement between the Customer, Optiontown and TAP Air Portugal. In the event of any contradiction between the Optiontown Terms of Service and these TAP Flight Pass Terms, these TAP Flight Pass Terms shall prevail.

DEFINITIONS

"Advance Booking" refers to the minimum number of days that reservation must be made, before travel date.
"Cabin" refers to the travel class, e.g. Economy Class or Business Class.
"Customer" refers to one or more persons that travel on TAP Air Portugal and who have signed for OT Service - Flight Pass.
"Flight Confirmation" refers to the deadline before departure date, when Optiontown will confirm the final selected Flight and notify the Customer based on pre-selected Flights.
"TAP Flight Pass" or "Flight Pass" refers to the pass provided by Optiontown under the FPo Service to its Customers which makes them eligible to book TAP Air Portugal Flights falling under criteria mentioned in these FP terms and conditions.
"Flight" or "Flights" refers to marketing and operated TAP Air Portugal (TP/WI/NI) flights.
"FP Service" refers to Flight Pass, the service being facilitated by Optiontown on behalf of TAP Air Portugal.
"Number of Flights" refers to the total number of Flight Credits included in the Pass.
"Optiontown" refers to the brand name and "www.optiontown.com" refers to the domain name and website of OT.
"OT Services" comprises of the various services offered by OT, wherein each such service is in general referred to as "OT Service". TAP Flight Pass Service or TAP Flight Pass or Flight Pass or FP Service or FP is the OT Service for TAP Flight Pass product.
"Passenger(s)" refers to the total number of distinct passengers who can use the Flight Credits. Choose more passengers in order to provide Flight Pass to be accessible to more people.
"Tax Payment Option" refers to the option to include or not include the taxes in the Flight Pass. The terms "Taxes" or "Tax", or "taxes and fees", here refer to all the taxes, fees and surcharges levied by government, airport and other third-parties.
"Travel Period" refers to the Time Period in which passengers can book Flights and use Flight Credits from their Flight Pass.
"Travel Zone" or "Zone" defines the set of all destinations where passengers can fly to/from by using the Flight Pass. This includes all flights operated by the airline inside Portugal (domestic) or between Portugal and Europe or North Africa. A customer will select a Travel Zone that covers all the destinations he/she desires to travel to/from. It might be a city pair (only between two cities) or between Portugal and other country.

CONDITIONS

The Purchase of Flight Pass and subsequent exchange of bookings for ticket issuances can only be done through the flightpass.flytap.com or optiontown.com website. The customers will NOT be able to make changes on their Flight Pass or to their associated tickets, through www.flytap.com, TAP Air Portugal Contact Center or any ticket counter.

Upon completion of the Flight Pass purchase, the customer will:

a.	Be able to book and travel to the selected 'Travel Zone' within the 'Validity' of the Flight Pass, according to the customized features;
b.	Agree that a one way booking will consume 1 Flight Credit at a time per passenger. For a round trip travel, each passenger will consume 2 Flight Credits at a time. However, each Flight must be booked separately, and each reservation must have only one flight. Travelling to certain destinations may require a return ticket. So, the passenger is requested to check the travel requirements of the country he/she is travelling to. If a return ticket is required for travel to a country, the passenger must ensure that has a valid return ticket and also valid travel documents for example visa. No claim will be accepted for any denial to enter into a country due to no return ticket or invalid/insufficient travel documents or due to invalid visa etc.;
c.	Be able to add new passengers, until the maximum limit of passengers Eligible Travelers is reached;
d.	NOT be able to edit the NAMEs and DATEs OF BIRTH of the added passengers.
e.	Be able to add Special Service Requests (SSRs) to the flight booked, such as disability assistance, at https://www.flytap.com/en-pt/booking-information/personalised-assistance;

Customer agrees and understands that the real time price may be lower or higher than the regular price displayed, hence the savings may be more or less than the displayed amount. Customer agrees and confirms unconditionally that he/she has taken the informed decision with the clear understanding and knowledge of the above. Customer irrevocably and unconditionally agrees that will not hold TAP Air Portugal responsible in any manner whatsoever for any difference in regular prices and/or savings displayed and cannot cancel the TAP Air Portugal or OT Services due to this.

Flights booked with Flight Pass are subject to seat availability in the booking class allowed for the chosen Advance Booking, as given below. For example, if customer purchased 7 Days advance booking for a Flight Pass for Economy, then customer can book a flight subject to seat availability in S class of that flight. If customer purchase 14 Days advance booking for a Flight Pass for Business, he/she can book a flight subject to seat availability in Z booking class in that flight.

If your intended flight does not have seats available in your Flight Pass booking class, that flight may not appear on the flight offer, even if it has availability in other booking classes within the same cabin, and if you still wish to book that specific flight, you may have to pay extra for higher booking class availability.
In order to access to the last available seat in the cabin for which you purchased your Flight Pass, you must purchase a Pass with 3 days, 2 days, 1 day or 4 hours of advance booking. The shorter the time of advance booking acquired, the less availability restrictions you will have.

Unlimited Flight Pass conditions

Unlimited flight bookings - Unlimited Flight Pass allows to book unlimited number of flight bookings for regular travel purposes for only the enlisted passengers to included Travel Zone subject to other Flight Pass conditions.

All bookings must be made as per the advance booking condition, seat availability in eligible booking class and other terms for your purchased Flight Pass.

No extensions or name change allowed - After the purchase, the Unlimited Flight Pass cannot be extended further. Once the passenger name is added, the passenger name cannot be edited or changed to a different passenger name.

Unlimited Flight Pass is non-refundable and non-cancellable.

Flight Change for Unlimited Flight Pass - Flight Change can be done by paying applicable change fees. If the new flight is outside the Flight Pass parameters, an additional fare difference will be charged.

Flight Cancellation for Unlimited Flight Pass - Flight can be cancelled by paying applicable cancel fees.

No-show fee for Unlimited Flight Pass

•	If you are not present at the time of boarding of your flight, then you will be considered a "No-show" for your flight, and there will be a No-show penalty of EUR 200 per passenger per flight and additional admin fees.
•	If any No-show penalty is not paid in time, then You will not be allowed to redeem your Flight Pass to book more flights and all future booked flights will be put on hold.
•	If you are a No-show for the outbound flight in a round-trip booking or multi-city booking, then you will be considered No-Show for all flights that depart after your said flight where you were No-show. For example, if you are a No-show for outbound journey of a round-trip booking, then you are considered No-show for both your outbound and return journey.
•	If an unlimited Flight Pass has more than one enlisted passenger, and only some of the enlisted passengers are No-show for any flight, then also none of the passengers are allowed to redeem the Flight Pass until when all the applicable fees for No-show are fully paid for.

Maximum limit on concurrent future dated bookings - At any given point of time, You are allowed to book at most 6 concurrent future dated bookings (that consume a total of 6 flights). If you have already booked 6 future dated flights which are not yet flown, then you will not be allowed to make additional bookings till you fly on at least one of your bookings.

Restriction against unauthorized usage or abuse - Unlimited Flight Pass is only meant for personal travel or regular corporate/business travel. Its prohibited to use Unlimited Flight Pass for any purpose that falls outside the normal personal or business travel purpose. For example, it's not allowed to use Unlimited Flight Pass by travellers whose main travel objective is to transport baggage for others on passenger flights. Optiontown reserves the right to detect such unauthorized usage and cancel such Unlimited Flight Passes and there will be no refund back to any customer in such a situation.

For customers who wish to buy a Flight Pass for transporting baggage through passengers traveling with baggage, or for any other purposes that falls outside the regular travel purpose, you may purchase a Flight Pass with a pre-defined number of flights. For any special requests, you may contact Optiontown at [email protected].

Rest of the conditions are same as applicable to other Flight Passes.

Tax Payment Option Conditions

This opton offers choice to either include or not include the taxes in the Flight Pass. Two choices are offered.

•	Tax Included - Under this option, the taxes are included in the Flight Pass price. So, under normal circumstances, you would not need to pay for taxes at the time of flight booking (exceptions apply). Therefore, the Flight Pass price includes the base fare, airline surcharges including fuel surcharge and all taxes and fees levied by government and third parties.
•	Tax Not Included - Under this option, the taxes are not included in the Flight Pass and You need to pay for taxes, fees and surcharges levied by government, airport and other third-parties at the time of flight booking. The Flight Pass price only includes the base fare and airline surcharges including fuel surcharge.

Exceptions to the above condition : In both of the above choices, the following exceptions apply.

•	In the event if any of the taxes and fees increase after they have been paid for, then you are liable to pay for additional taxes and fees amount before flight departure.
•	In the event if any of the taxes and fees increase due to any flight changes made to your booking, then you are liable to pay for additional taxes and fees at the time of flight change.

if you choose the "Tax Not Included" option at the time of Flight Pass purchase, then later on you can upgrade to "Tax Included" through the Manage My Pass feature by paying the applicable taxes and fees.

Flight Pass price excludes any surcharge that may be levied by Optiontown, like a service fee or credit card fee. Service fees may apply for changes to the purchased Flight Pass or for changes to the bookings that were made.

Flight Pass prices may vary across different Customers whether booked on the same flight and having the same parameters.

The invoicing for the purchase of the Flight Pass will be the responsibility of TAP and Optiontown, and each company will be responsible for sending the invoice corresponding to the amount received by the costumer. In practice, the costumer will receive two invoices: one from TAP and another from Optiontown.

10.

Mobility Subsidy - To qualify for the Mobility Subsidy you may purchase a bidirectional Flight Pass exclusively between a single city on the Islands and a single city on the Mainland for one or more passengers, provided that they all comply with all requirements for the Mobility Subsidy. It will not be possible to apply for this subsidy in the purchase of a Flight Pass for several passengers, if some of which meet the requirements and others do not.

Since there will be a single invoice representing all the Flight Coupons purchased, plus a receipt issued by Optiontown, there will be no room for an individual invoice associated with each ticket. To request the Mobility Subsidy from CTT, you must send an e-mail to [email protected] asking for proof of each ticket issued and flown from your Flight Pass. You must collect the two invoices, the proof of the ticket and the boarding pass and present the documents for each ticket, that is, each time you apply for the Subsidy. The deadline for submitting documentation is the usual deadline, with no exceptions because it's a Flight Pass.

If the Customer wishes to add any Extra Services (such as extra baggage, lounge access, Fast Track/Greenway, or any other special service), he/she must contact TAP Air Portugal directly via www.flytap.com or over the phone at the Contact Center for TAP Air Portugal. Please note TAP Air Portugal may levy an additional charge for these Services as per regular TAP Air Portugal policy (it depends on which type of Branded Fare was acquired at the purchase).

12.

Customer can earn miles according to the Brand policy of TAP Air Portugal. TAP Miles & Go miles can only be earned for the passenger who actually uses the ticket and the miles credited vary according to the brand fare used (Classic or Plus for Economy Class and Executive or TOP Executive for Business Class).

13.

Flight Pass is NON-refundable and non cancelable once purchased. Anypayment once paid is NON-refundable under all circumstancesexcept in case of exceptional circumstances as mentioned below. No portion of the total Flight Pass price will be refunded in case of any unused Flight credits.

Exception Circumstances for Refund

a.	If and only if, TAP Portugal stops flying or reduces the flight frequency drastically to all city pair routes/destinations including in your Flight Pass, or a Force Majeure event (like Covid-19) occurs and You have still unused flight credits, then you may request refund for only those unused Flight Pass credits. In this event, TAP Portugal will be solely and fully responsible to refund the amount. Refund request will be at the discretion of the Airline. Optiontown will not be responsible to pay back any refund amount to You in this situation.
b.	In the event that TAP Portugal is unable to facilitate booking reservation for a valid purchased Flight Pass for any reason, then TAP Portugal will be fully and solely responsible to provide the refund of the amount related to unused/unflown tickets. Optiontown will not be responsible to pay back any refund amount to You in this situation.
c.	Contact Optiontown via [email protected] to request such a refund and Optiontown team will notify TAP Portugal for such refund requests.
d.	Notwithstanding anything said to the contrary, if the payment amount related to a Flight Pass has been transferred by Optiontown to TAP Portugal, then the complete financial responsibility for refund of total paid amount for said Flight Pass rests solely on TAP Portugal, and Optiontown does not have any responsibility for the refund amount and Optiontown cannot be held responsible for the refund amount.

14.

Once a Flight Credit is redeemed from a Flight Pass Account and a ticket is issued, these tickets are NON refundable. All Flight Pass fares allows to cancel these tickets and its Credits will return into Flight Pass Account, but no money will be refunded. In all circumstances the Flight Pass remains Non-refundable.

15.

No-shows are not permitted. In case of no show, tickets are non-refundable and no value will be credited back onto the Flight Pass account, except as mentioned otherwise in some specific cases.

16.

Flight Pass is only available to be used by adults and children over 2 years of age. It is possible to add infants after the booking is created under Flight Pass conditions, by paying the appropriate fares, fees and taxes which may be levied at TAP Air Portugal. Children discounts are not applicable. Children under 12 years of age must always travel accompanied by at least one adult who should be included in the same Flight Pass. The "Unaccompanied Minor" service under the Flight Pass is not allowed.

17.

Flight Pass is NOT transferable, and cannot be sold or exchanged for cash. The Journey entitled under a Flight Pass cannot be exchanged, unless if TAP Air Portugal decides to.

18.

Specific policies and rules, if applicable to TAP Air Portugal, will be displayed under the Flight Pass Terms and Conditions and would accordingly be applicable to the Customers.

19.

With Flight Passes all fares allows changes. For the Discount and Executive Fare Types, the flight date and time can be changed before departure of the flight, upon payment of a penalty per passenger (please see the table below with the penalty amounts)*. There is also an administrative fee that is charged by Optiontown, for every payment transaction and might also exists an additional surcharge if you pay by credit card.

*Please note that new flights must fulfill all the conditions of the purchased Flight Pass and as a result, no fare difference will be assessed.
a. The Flight Changes can only be done online by logging to your Flight Pass account.
b. Name Correction - It is only possible to correct a maximum of 3 characters in the name item. Please make sure that the name on the Flight Pass matches the passenger's Passport (First Name and Surname) details.

20.

Flight Passes Classic, Plus and TOP Executive allow changes without penalty, since all the Flight Pass conditions still be accomplished. Otherwise, a difference to the new conditions (if permitted) will apply.

No-show and refund are not allowed for any Flight Pass.

21.

The Flight Pass is a TAP Air Portugal product that is commercialized in collaboration with Optiontown. All payments are made directly to Optiontown. Customers will agree that they cannot challenge or dispute a charge if the name appearing on their credit card statement is different than the one mentioned above.

22.

To the extent permissible by local law or regulation, these Flight Pass Terms and Conditions shall be governed in accordance with the Portuguese law. TAP Air Portugal and each Customer submits to the NON-exclusive jurisdiction of the Portuguese courts to resolve any disputes that may arise out of them.

23.

If any provision of these Flight Pass Terms are declared void or unenforceable by any competent authority or court shall, to the extent of such invalidity or unenforceability, be deemed severable and shall not affect the other provisions remaining which shall continue unaffected.

24.

TAP Air Portugal and Optiontown accept no responsibility for damage or loss resulting from misdirected or incomplete entries arising from computer malfunctions, viruses, bugs or other such causes. TAP Air Portugal and Optiotnown are is in no way liable for the reproduction or indirect access via third party web site or home page access which reproduction misstates or omits any of the information or terms and conditions connected with the Flight Pass.

TAP Air Portugal and Optiontown reserves the right to change these Flight Pass Terms and Conditions at any time.
